Greg Abbott said the US Supreme Court ruling on birthright citizenship was a “missed opportunity”. That is like an umpire looking for an opportunity to make the Rangers lose. Abbott should know better. As a lawyer, state supreme court justice, attorney general, and governor he should understand that judges are not legislators. Court cases are not opportunities to change policy. If you want activist judges that legislate from the bench, consider running for the legislature where laws are made. Courts are not intended to make law.
US Supreme Court judges are appointed and confirmed for lifetime appointments. Texas supreme court justices are elected. The governor of Texas can criticize the arguments and rulings of judges, but has no jurisdiction over judges when a governor thinks a case is an opportunity for a policy change. The only recourse is legislation.
